1. Seller
PRECURE ApS, CVR 46512987, Bryggeristræde 2, 3770 Allinge, Denmark. Email: mail@precure.dk. Website: precure.health.
2. Who these terms apply to
These terms apply when you buy the risk assessment assistant, workplace checks or the individual program on precure.health. You accept them when you pay. The agreement is made when the payment has gone through, and you receive a confirmation by email.
The risk assessment assistant, workplace checks for companies and the individual program are sold only to companies and other businesses. Workplace checks for private customers are sold to consumers. Where these terms mention consumers, they apply only to private purchases.
3. Products and prices
- Risk assessment assistant: DKK 3,000 per year excl. VAT for one company, with any number of employees and assessments.
- Workplace check for companies: a number of checks that employees use through a shared link. In each purchase, the first 5 checks cost DKK 29 each, checks 6–100 cost DKK 20 each, and from check 101 they cost DKK 19 each, excl. VAT. Not a subscription.
- Workplace check for private customers: 1 check for DKK 29 or 5 checks for DKK 99 incl. VAT. Not a subscription.
- Individual program: DKK 2,998 per participant excl. VAT. A six-week program for one employee with a sensor vest or sleeve and three consultations with a healthcare professional. The equipment is lent, see Section 9. Not a subscription.
- The first workplace check in a browser is free. We may change or end the offer of a free check.
Checks you buy are valid for 12 months from the purchase. Checks not used by then expire without a refund, unless you withdraw from the purchase as a consumer under Section 6.
Prices for companies are excl. VAT, and VAT is added at payment. Prices for private customers are incl. VAT. We charge no other fees.
4. Payment
Prices are in Danish kroner. You pay through Stripe by card or the other payment methods shown at payment. If you pay in another currency, Stripe shows the total price in that currency, including any conversion fee, before you pay. The amount is charged when you complete the purchase. Stripe handles the payment details; we never see or store card numbers. You receive an invoice or receipt by email.
5. Risk assessment subscription: renewal, price changes and cancellation
The risk assessment assistant is a subscription. It runs for 12 months and renews automatically for 12 months at a time until cancelled. The price for the new period is charged to the payment method linked to the subscription. You receive a reminder by email before the subscription renews.
You can cancel at any time under Account, with the button for invoices, card and cancellation. Cancellation takes effect at the end of the paid period. A started period is not refunded.
We may change the price with effect from the next renewal. We will tell you by email at least 30 days before the renewal, so you have time to cancel.
If the payment at renewal does not go through, Stripe tries again. If the payment still fails, you can no longer change assessments until it is paid.
When a risk assessment subscription has ended, you can still view, export and delete your assessments, but not change them. Assessments are deleted 4 years after their last change, as described in the privacy policy.
6. Right of withdrawal (consumers)
As a consumer you have a 14-day right of withdrawal from the day the agreement is made. The checks are digital content that you can use straight away. When you buy, you give your express consent to delivery starting at once, and you acknowledge that your right of withdrawal ends when you have used the first of the checks you bought. You receive a confirmation of this consent on the invoice.
If you have not used any of the checks, you can withdraw within the 14 days by sending a clear statement to mail@precure.dk, for example “I withdraw from my purchase of workplace checks on [date]”. You may also use the standard withdrawal form from the Danish Competition and Consumer Authority, but you don’t have to. We refund the full amount no later than 14 days after we receive your message, using the payment method you used. Withdrawing costs you nothing.
Companies have no right of withdrawal.
7. What the tools are
The workplace check gives ergonomic guidance based on photos and answers. It is not a diagnosis and does not replace an examination by a doctor or other health professional. If you have pain that does not go away, you should seek advice from a health professional.
The risk assessment assistant helps a company make its risk assessment. The company is responsible for the assessment being correct and for meeting the occupational health and safety rules. AI suggestions can be wrong or incomplete and must always be reviewed before they are used.
8. The company’s workplace check link
A company that buys workplace checks gets a link, which it shares with its employees itself. Every check made through the link is deducted from the company’s checks. The company is responsible for who it shares the link with, and can make a new link at any time under Account, so the old one stops working.
9. The individual program and loaned equipment
After the purchase we contact you within 2 working days to agree the start. The program runs for six weeks from the day the participant receives the equipment.
You buy access to the program, not the equipment. The sensor vest or sleeve and its accessories belong to PRECURE ApS and are lent for the program. The participant must handle the equipment with care and use it as described.
The equipment must be returned no later than 14 days after the program ends. We send a return label. If the equipment is not returned in time, or is damaged beyond normal wear, we invoice the company DKK 1,500 excl. VAT per unit as compensation.
If you cancel the program before we have sent the equipment, we refund the full amount. Once the equipment has been sent, the program is not refunded.
10. Operation
We work to keep the tools available and working, but cannot promise that they always are. There may be interruptions, for example for maintenance or faults at our suppliers. We may improve and change the tools, as long as they still do what you bought.
We may close an account or a link if it is used against these terms or for misuse, for example attempts to get around payment or attacks on the service.
11. Defects and complaints about defects
If something you bought does not work as it should, write to mail@precure.dk and describe the problem.
If you are a consumer, you have a 2-year right to complain about defects under the Danish Sale of Goods Act. You must complain within a reasonable time after discovering the defect. A complaint made within 2 months is always in time.
If you are a company, you must complain within a reasonable time. We fix the defect or, if that is not possible, give a proportionate price reduction or refund the part of the payment the defect concerns.
12. Personal data
See our privacy policy. Photos from the workplace check are not stored. If an employee shares their result with their employer, only the month, score, the status of the six areas, and whether the employee has pain and whether it is long-lasting are stored, without name or other identifiers. It is shown only once at least 3 people have shared.
For the employees’ answers in the risk assessment assistant, the company is the data controller and PRECURE ApS is the data processor. The terms of our processing are set out in the data processing agreement, which forms part of this agreement.
13. Liability
Towards companies, our total liability is limited to the amount the company has paid for the product in question in the last 12 months, and we are not liable for indirect loss, such as operating loss, lost profit or loss of data.
Towards consumers, we are liable under the general rules of Danish law.
These limits do not apply if we have acted intentionally or with gross negligence.
14. Changes to these terms
We may change these terms. Changes apply to new purchases from the day they are published here. For a running risk assessment subscription, material changes apply from the next renewal, and we will tell you by email at least 30 days before.
15. Complaints
Write to mail@precure.dk and we will find a solution.
If you are a consumer and we cannot agree, you can complain to the Danish Centre for Complaint Resolution (Center for Klageløsning), Nævnenes Hus, Toldboden 2, 8800 Viborg, Denmark, naevneneshus.dk. If you live in another EU country, you can also contact the European Consumer Centre in Denmark, forbrugereuropa.dk.
16. Governing law and venue
Danish law applies. If you are a consumer, you always keep the protection that mandatory rules in your country of residence give you.
Disputes with companies are settled by the court of Bornholm (Retten på Bornholm) as the first instance.
These terms are available in Danish, English and Spanish. If the versions differ, the Danish version applies.
